We help users research and book travel experiences, services, and tickets by using our website OneDayTours.pt.
These Terms and Conditions apply to any use of One Day Tours services. Please read these Terms and Conditions carefully, as they contain important information concerning your/your travel companion/or third parties to whom you have reserved the services on behalf, legal rights, limitations on these rights, and a section regarding applicable law and jurisdiction of disputes. By accessing or using One Day Tours' services, you agree that you have read these Terms and Conditions and are obliged to follow them. If you do not agree with all of these Terms and Conditions, you are not permitted to access or use the services. You should also read our Privacy Policy, which also governs your use of our services.
In the event of any conflict, the terms and conditions herein shall prevail.
Introduction
1.1 These Terms and Conditions, together with the Privacy Policy (collectively, the "Terms and Conditions") set out the terms on which One Day Tours Portugal, LDA. ("One Day Tours", "we", "us, "our" ) provides services (the "Services") through One Day Tours' website (https://onedaytours.pt), together with all related domains, white label and affiliate sites, mobile properties, and related applications, collectively referred to as the "Website") and over the telephone. When we refer to "you", we mean any person that accesses or uses the Services.

1.3 These Terms and Conditions govern your relationship with us in respect of your use of the Services, including any bookings that you make of any tour, ticket, attraction, activity, and/or experience (described in these Terms and Conditions as an "Experience") that is advertised on the Website.
1.4 By using or accessing the Services, by booking an Experience("Book", "Booking"), and/or creating an account on the Website (a "One Day Tours Account"), you agree to follow Terms and Conditions without modification, and you represent that you have read and understood them. In all Booking arrangements, the person making the Booking shall be deemed to have accepted these Terms and Conditions on behalf of all the persons named in the Booking.
1.5 One Day Tours keeps the right to update or modify these Terms and Conditions at our own discretion. You agree to accept the updated terms by continuing to use the Services after such changes. The date of the last update will be noted at the top of this page. You are responsible for regularly reviewing the most current version of the Terms and Conditions.
1.6: The website may include translations provided by Google. Google disclaims all warranties regarding these translations, including accuracy, reliability, and any implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Use of the Services
2.1 By using our Services, you confirm that all information you provide is accurate and that you're no less than 13 years old as we don’t collect data from individuals under 13. Your use of the Services is for personal, non-commercial purposes, and you’re not allowed to use the Services for illegal or speculative bookings.
2.2 The Users are prohibited to misuse the Services, including being suspended or banned, cooperating with competitors, or creating multiple accounts. You must have the authority to agree to these terms without violating other agreements. We reserve the right to ban anyone at any time for any reason. Offensive or inaccurate content may occur while you’re using the Website. We don't endorse such content and you proceed at your own risk.
One Day Tours Accounts
3.1 To get access to certain features and make bookings on the website and services, you'll need to create a One Day Tours Account, providing reliable information. In case if you notice any unauthorized use, you should immediately notify us. Keep your account password and log-in credentials ("One Day Tours Account Credentials") confidential.
3.2 Your One Day Tours Account is strictly personalized and only for your use. Don't create accounts for anyone else, and don’t use fake information.
3.3 The right to suspend or terminate your One Day Tours Account and access to our services is reserved at our discretion.
3.4 You can delete your One Day Tours Account anytime by contacting us. Your user content may still be visible for other visitors.
3.5 You acknowledge, that by using our service neither One Day Tours nor its affiliates are liable for unauthorized bookings made using your account credentials. Unauthorized account use may result in liability to you and other users.
Website Prohibited Activities
4.1 The Website's content and information are the proprietary assets of One Day Tours. You're prohibited from modifying, distributing, copying, or using the content for commercial purposes unless we give you written permission for that. Prior consent from One Day Tours is required for any use.
4.2 You agree not to use the Website or its content for commercial purposes or unlawful ones. You agree not to assist others in making copies of content through automated means without One Day Tours permission. The list of prohibited activities includes plagiarism of the Website's information, software modification, or deep-linking without permission. Strict prohibition is distributed on harmful actions such as harassment, spamming, or promoting discrimination. Any interference with the Website's security features is also forbidden.
Electronic Communications
5.1. When you use the One Day Tours Website or send e-mails, text messages, and other communications from your desktop or mobile device to us, you are communicating with us electronically and agree that we may communicate with you in a variety of ways, such as by e-mail, or by posting notices and messages on the Website. You may unsubscribe from marketing-related e-mails by emailing unsubscribe@OneDayTours.pt, however, we may continue to send you non-marketing messages, such as messages related to any upcoming Bookings.
5.2 As part of our Services we share information with our suppliers in order to provide you with information about special offers, products, and services that might interest you. Such information will typically be sent through newsletters and marketing communications and represent efforts to get to know you and your preferences better across our Services. In turn, this enables customization of the services in line with those preferences.
Content
6.1 The users of the Website may contribute to the Website in several different ways. We're delighted to have you join our community and contribute to the richness of our platform. Your engagement is pivotal in shaping memorable experiences for our users. By interacting with our Website, you acknowledge and agree to the following terms and conditions concerning content contribution. At One Day Tours, we encourage users to share their experiences and recommendations to contribute to the travel journey for others. Whether it's through submitting reviews, posting captivating photos, offering valuable feedback, or engaging in lively discussions, your contributions play an indispensable role in creating the community.
6.2 You grant One Day Tours and its affiliates the necessary rights to utilize and display your contributions across various mediums and platforms by sharing any form of User Content. You acknowledge and agree that User Content is non-confidential and non-proprietary. We respect intellectual property rights and moral integrity. Thus, if you retain any moral rights in your User Content, you explicitly provide your consent for its utilization, modification, and publication by One Day Tours. Any violations of these guidelines may result in the removal of User Content and potential consequences for the offending user.
6.3 You assume all the risks associated with User Content, taking responsibility for the User Content you submit. You assume all risks associated with such User Content, including anyone's reliance on its accuracy, completeness, or usefulness, or any disclosure by you of information in such User Content that makes you personally identifiable. One Day Tours doesn’t sponsor or endorse such User Content.
6.4 One Day Tours reserves the right to screen, edit, or monitor any User Content even though it’s not an obligation.
6.5 One Day Tours is not obliged to guarantee any confidentiality concerning your User Content.
6.8 Any use by you of the Interactive Areas or other portions of the Website in violation of the preceding violates these Terms and Conditions and may result in, among other things, termination or suspension of your rights to use the Interactive Areas and/or the Website.

7.1 Excluding Third Party Content, the Website and all content of the Website including, but not limited to, all visual interfaces, interactive features, custom graphics, design, computer code, products, software, compilation of other content (such as compilation of third party content), and other elements and components of the Website are: ©2024 One Day Tours Portugal, LDA. All other product or service names or slogans displayed on the Website (including those of the Experiences) are registered and/or common law trademarks of One Day Tours Portugal, LDA. and/or its suppliers or licensors, and may not be copied, imitated, or used, in whole or in part, without the prior written permission of One Day Tours or the applicable trademark holder. In addition, the look and feel of the Website, including all page headers, custom graphics, button icons, and scripts, is the service mark, trademark, and/or trade dress of One Day Tours and may not be copied, imitated, or used, in whole or in part, without the prior written permission of One Day Tours. All other trademarks, registered trademarks, product names, and company names or logos mentioned in the Website are the property of their respective owners. Reference to any products, services, processes, or other information, by trade name, trademark, manufacturer, supplier, or otherwise does not constitute or imply endorsement, sponsorship, or recommendation thereof by One Day Tours.
7.2 If you are aware of an infringement of either your brand or our brand, please contact us. We only address messages concerning brand infringement at the email address copyright@onedaytours.pt.
Experiences and Booking Reservations
8.1 One Day Tours operates the Website through which you can enter into a contract with either us or a third party supplier of an Experience("Supplier"). One Day Tours is a supplier of some advertised Experiences, and your contract for the supply of any Experience you Book will be directly between you and the applicable Supplier. Terms and conditions on the Website and those of the Supplier apply in case of booking such an Experience. If you have queries not addressed on the Website, contact us before booking. Once booked, cancellation follows the Experience listing's policy.
8.2 By booking, you agree to the Supplier's terms and any related rules. If conflicts arise between Supplier Terms and our Terms and Conditions, ours prevail. Interactions with Suppliers are at your own risk, and we bear no liability for their actions. Our facilitation of bookings does not imply endorsement or affiliation with Suppliers. We don't endorse or recommend any specific Experiences, and information accuracy is not guaranteed.
8.3 When booking, you confirm you're at least 18, have legal authority for the agreement, and will use the Website for legitimate bookings only.
Pricing
9.1 The prices shown on this website are per person unless specifically indicated. Your trip is not confirmed until you receive a booking confirmation from One Day Tours and your payment has been received by us.
9.2 Prices are based on the local tariff at the time of quoting, converted at the prevailing foreign exchange rate as determined by One Day Tours. See Section 12 for more information about currency conversions.
9.3 Price quotations are subject to change without notice until a Booking has been made.
9.4 Unless the Supplier has otherwise specified, prices do not include any local taxes or use fees, including foreign departure, security, port charges, park fees, customs, immigration, agricultural, passenger-facility charges, or international transportation tax.
9.5 Inclusions are determined by the Supplier. Prices do not include tips/gratuities; passport and visa fees; baggage and personal insurance; any items of a personal nature; taxes or duties; and any beverages or food not specifically stated as included by the Supplier.
9.6 In the case of invoicing errors, One Day Tours reserves the right to re-invoice with updated pricing up until the Booking Confirmation is sent to you. You are entitled to a full refund of your trip deposit if you do not accept the changes.
Currency Conversions
10.1 If One Day Tours provides a currency converter, currency rates are based on various publicly available sources and should be used as guidelines only. Rates are not verified, and actual rates may vary. Currency quotes may not be updated on a daily basis, and One Day Tours and its affiliates do not warrant or guarantee accuracy. One Day Tours shall not be liable to you if prices change due to currency fluctuations.
Payments
11.1 When you make a Booking, One Day Tours will collect your payment information and will process your payment as described in Section 13.3. Full payment by credit or debit card is required to make a Booking unless otherwise specified. The payee may be referenced as One Day Tours Portugal, LDA on your statement.
11.2 The value of your Booking may be subject to taxes, duties, foreign transactions, currency exchange, or other fees. Your bank or payment card company may convert the payment into the local currency and may charge fees, resulting in differences between the amount displayed through the Platform, and the final amount charged to you. One Day Tours recommends that you contact your bank or card company if you have any questions concerning any applicable currency conversion or fees.
11.3 Under these Terms and Conditions, the payment processing services for the Services provided are provided by One Day Tours Portugal, LDA, Stripe Payments Europe, Limited (“SPEL”); and Stripe Technology Europe, Limited (“Stripe PSP”). The registered office address of One Day Tours Portugal, LDA is Estrada do Algueirão, № 148 A - 2725-021 Mem Martins, Portugal. The information about SPEL and Stripe PSP can be accessed on the respective website https://stripe.com.
Modifications or Cancellations
12.1 After Experience purchase, changes or cancellations aren't permitted unless stated otherwise. If you want to modify your booking, it's at the Supplier's discretion. You must arrive at the designated meeting point at the specified time. For certain Experiences, specific details are sent via email after booking, so ensure you check it. If you don’t come on time, the Supplier might provide an alternative, but they're not obliged, and you risk losing refund or rebooking options.
12.2 Changes or cancellations are allowed by the standard cancellation policy up to 48 hours before the start time of the booking. For Experiences with no fixed start time the deadline is typically 11:59 pm, three days before the start date. Cancellations must be emailed to cancellations@onedaytours.pt, while changes require an email to changes@onedaytours.pt. Include your booking number and the details you want to change or cancel.
12.3 For any Experience marked as 'All Sales Final' or similar (including group bookings), it's non-refundable and unchangeable after booking. Different cancellation policies apply to some Experiences. Always review the cancellation policy in the Experience listing at the time of booking to understand your cancellation terms and potential refunds.
12.4 Except for Sections 15.2 and 15.3, (a) Change Requests, including date changes, must be emailed to change@onedaytours.pt; (b) One Day Tours won't charge a fee for implementing Change Requests if received by the specified deadline. Note that Suppliers may charge a fee for changes, which you'll need to pay for One Day Tours to process your request.
12.5 Change Requests are processed by One Day Tours based on Supplier availability and agreement. If the
Supplier can't accept the Change Request, your refund rights follow the booking's cancellation terms. The responsibility for cancelation is yours before any refund deadline, even if you’re awaiting a Supplier's response to a Change Request.
12.6 If you make a Booking using a promotion code, or if you accept a discount or special-offer price during the check-out process, you may invalidate your discount or special-offer price by making a Change Request after Booking.
12.7 No refunds are available once an Experience has commenced, or in respect of any Experience's package, accommodation, meals, or any other services that have started to be utilized.
12.8 All sales of tickets for events, attractions, shows, etc. are final and non-refundable in any circumstances.
Other Modifications and Cancellations
13.1 If a Supplier changes an Experience you've purchased considering dates, prices, inclusions, or other features, One Day Tours can cancel, modify, or substitute it for any reason. If the Supplier's change is significant and you're not satisfied with the alternative offered, you'll receive a full refund.
13.2 We may, at our discretion, withdraw our Services for your safety, the Supplier's, or your interests, following Experience's cancellation policy and effectively canceling a Booking. We may also, at our discretion, refund part or all of the charged amounts to you. You agree that neither we nor the Supplier are liable for such cancellations or refunds
Travel Documents
14.1 It’s your responsibility to meet entry requirements and have the necessary travel documents, like passports and visas when you make a booking with us. Keep in mind that these requirements can change, so it's crucial to check with the relevant embassy or consulate before booking and departing. We can't be held liable if you're denied entry to a flight or a country, even if you're just passing through.
14.2 Health and visa requirements can also change suddenly, so We strongly advise you to confirm with the appropriate consulate before your trip the requirements for visa and health. Consult your physician for vaccination recommendations and ensure you meet all health entry requirements. To have a safe trip it’s important to be informed and follow any medical guidance related to your journey.
14.3 For safety reasons, we highly recommend purchasing comprehensive travel insurance before your departure. If you need to cancel your trip or alter your travel dates significantly, your insurance policy may cover cancellation fees and related expenses. Make sure to review your policy carefully to understand its terms and conditions.
14.4 Most travel are completed smoothly, but certain destinations may pose greater risks. We recommend our customers to research travel advisories issued by the United States Government and destination country governments before booking international travel. Information on conditions in various countries and the level of risk associated with travel to particular international destinations can be found at www.state.gov, www.tsa.gov, www.dot.gov, www.faa.gov, www.cdc.gov, www.treas.gov/ofac, and www.customs.gov.
14.5 One Day Tours doesn't guarantee safe travel to any destination and isn't responsible for any resulting damages or losses.
Disclaimer and Liability Limitations
15.1 The information in this section limits One Day Tours' liability for issues related to your use of the services. If you don't understand these terms, consult a lawyer before using the services. Under no circumstances One Day Tours or its agents, affiliates, service providers, suppliers, and/or distributors be liable for any of the following losses or damage (whether such losses where foreseen, foreseeable, known or otherwise): (a) loss of data; (b) loss of revenue or anticipated profits; (c) loss of business; (d) loss of opportunity; (e) loss of goodwill or injury to reputation; (f) losses suffered by third parties; or (g) any indirect, consequential, special or exemplary damages arising from the use of Living Tours.com regardless of the form of action.
15.2 There can be inaccuracies or errors, including in reservation availability and pricing in information, content, software, and services provided by One Day Tours or suppliers. We reserve the right to correct errors in pricing and availability.
15.3 One Day Tours' affiliated companies are not responsible for the suitability of the information, products, and services offered. All information and services are provided "As IS," or "As Available" without warranty. One Day Tours disclaims all warranties, including regarding viruses or harmful components.
15.4 Suppliers are not the agents of One Day Tours, but independent contractors. One Day Tours is not liable for suppliers' actions or any resulting damages, injuries, or expenses. They are not responsible for events beyond their control.
15.5 One Day Tours (and affiliates) are not liable for any damages arising from product bookings or service use, even if advised of the possibility of such damages. If One Day Tours is found liable for damages related to service or product use, their liability will not exceed the sum paid for the booking or $100
15.6 These limitations of liability survive even if other remedies fail. They benefit One Day Tours' affiliated companies.
15.7 From our website, you can visit other websites by following hyperlinks to such external sites. While we strive to provide only quality links to useful websites, we have no control over the content and nature of these sites. These links to other websites do not imply a recommendation for all the content found on these sites. Site owners and content may change without notice and may occur before we have the opportunity to remove a link that may have become outdated or unrelated. Please be also aware that when you leave our website, other sites may have different privacy policies and terms that are beyond our control. Please be sure to check the Privacy Policies of these sites as well as their “Terms of Service” before engaging in any business or uploading any information.
Your Liability
16.1 By accepting these terms, you agree to defend and indemnify One Day Tours and its affiliated companies, and our respective directors, officers, members, employees, agents, representatives, attorneys, and successors. This means taking responsibility for any legal claims, losses, or expenses arising from various scenarios, such as breaking these terms, violating laws or rules, infringing on someone else's rights, using the services or website, booking experiences, or acting negligently or recklessly.
One Day Tours Vouchers
17.1 When booking your Experience with One Day Tours, you'll receive a voucher either from them directly or from one of the Suppliers. Don’t miss an email with the voucher sent by One Day to use it on time.
17.2 To redeem your chosen Experience, present the original voucher to the Supplier. Without this valid voucher, your booking won't be accepted. Ensure you review the terms and conditions to understand the Supplier's requirements for voucher presentation.
17.3 For security reasons, remember to bring along a valid photo ID and sign the voucher when redeeming. Some Suppliers may request the payment card used during the booking process, particularly for attractions and shows. You'll get a notification if this requirement applies to your booking. If you have any questions or concerns, don't hesitate to contact One Day Tours' Customer Care team for assistance.
General Provisions
18.1 You agree that no joint venture, agency, partnership, or employment relationship exists between you and any of the One Day Tours Group Companies as a result of these Terms and Conditions or use of the Services.
18.2 One Day Tours's correspondence to these Terms and Conditions is subject to applicable laws and legal processes. This does not restrict One Day Tours's right to comply with law enforcement or other governmental requests related to your use of the Services or information gathered by One Day Tours. You agree to bring any claims arising from your use of the Services within two years from when they arise or be waived.
18.3 If any part of these Terms and Conditions is found invalid or within the frameworks of the applicable law, it will be replaced by a valid provision that aligns with the original intent. The remaining provisions will remain in effect.
18.4 These Terms and Conditions constitute the entire agreement between you and One Day Tours regarding the Services. Printed copies of these Terms and Conditions and electronic notices are accepted in legal proceedings to the same extent as other business documents.
18.5 Any rights not expressly granted herein are reserved.
Jurisdiction and Governing Law
19.1 The Services are provided by a Portuguese entity and these Terms and Conditions are governed by the laws of Portugal. You hereby consent to the exclusive jurisdiction and venue of courts in Lisbon, Portugal, and stipulate to the fairness and convenience of proceedings in such courts for all disputes arising out of or relating to the use of the Services. You agree that all claims you may have against One Day Tours arising from or relating to the Services must be heard and resolved in a court of competent subject matter jurisdiction located in Lisbon, Portugal
19.2 Use of the Services is unauthorized in any jurisdiction that does not give effect to all provisions of these terms and conditions, including, without limitation, this paragraph. The foregoing shall not apply to the extent that applicable law in your country of residence requires the application of another law and/or jurisdiction and this cannot be excluded by contract.
Complaints Handling Policy & Procedures
20.1 As a responsible travel agency, we seek to maintain and enhance our reputation of providing you with high-quality products and services. While we don't like them, we do value complaints as they assist us in improving our products, services, and customer service. We are committed to being responsive to our customers' or potential customers' needs and concerns and resolving your complaint as quickly as possible.
